Competition Terms and Conditions

NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ENTRIES VOID WHERE PROHIBITED BY LAW.

PLEASE NOTE FOR CANADIAN RESIDENTS ONLY: A SKILL-TESTING QUESTION WILL BE REQUIRED TO WIN.

By submitting a competition entry, you are agreeing to be bound by these terms and conditions (copy also available at https://gangbeasts.game/tiktokcompetition).

1 Promoter Name.

Boneloaf Limited of Unit 1.09 Site Gallery 1 Brown Street, Sheffield, England, S1 2BS (referred to throughout these terms as the “Promoter”, “we”, “us” and “our”).

2 Competition Description.

Win the prize by liking the Competition Video, following the Gang Beasts TikTok account (https://www.tiktok.com/@gangbeastsgame) and commenting your favourite in-game moment in Gang Beasts on the Competition Video.

3 Prize.

Two winners will receive one of the following prizes (selected at random by us):

1x 12 pack of Gang Beasts stampers
1 x 12 pack of Gang Beasts collectible figurines

RRP ranges from $15.99-$41.99 per prize

4 Competition Duration and Deadline.

From 9:00 AM GMT on 15 November 2022 to 11:59PM GMT on 22 November 2022 (the "Closing Date") inclusive. All competition entries received after the Closing Date are automatically disqualified.

5 How to Enter.

(a) Like the video pinned to the top of the Gang Beasts TikTok at: https://www.tiktok.com/@gangbeastsgame (“Gang Beasts TikTok”) which announces the Competition (“Competition Video”)

(b) Follow the Gang Beasts TikTok

You do not have to pay to enter the competition, however you are responsible for any phone or internet charges you may incur in entering. If you are unsure about these charges, you should contact your phone or internet operator before entering. Entries will not be acknowledged and we do not accept responsibility for entries that are lost, delayed or which we do not receive.

6 Eligibility.

You must be aged 18 or over at the time of entry and a legal resident of the 50 United States, including the District of Columbia, European Union (including the United Kingdom), Canada (excluding Quebec) in order to enter this competition. Void in Puerto Rico, Guam, the U.S. Virgin Islands, Quebec, and wherever else prohibited by law. If you are under the age of 18, you must obtain written parental or guardian consent to enter and claim your prize. We may ask the winner to provide proof of age. Other residents will be admitted at our discretion and if permitted by applicable local law. We may require you to provide proof that you are eligible to enter the competition. No purchase necessary. One entry per person. You must enter the competition yourself. Entries which are incomplete, removed, corrupt or ineligible will not be accepted. We reserve the right to verify any entries and winners and may refuse to award prizes and/or disqualify you if you make or attempt to make any entry to this competition which is in our reasonable opinion contrary to these terms and conditions or by its nature unfair to other entrants. This might include entries which are made by automated means, fraudulent, made in bulk, made on behalf of another person, or made by hacking, cheating or deception. You must comply with the laws that apply to you in the location that you access the competition from. If any laws applicable to you restrict or prohibit you from entering the competition, you must comply with those legal restrictions or, if applicable, refrain from entering the competition. This competition is subject to all applicable federal, state and local laws and regulations.

7 Prize Conditions.

Prizes are subject to availability with no cash alternative. Prizes are not negotiable, exchangeable or transferable. Winner(s) will be announced in a video on the Gang Beasts TikTok on 22 November 2022 (“Announcement Date”). You must claim your prize personally within 1 (one) month of the Closing Date otherwise your claim will become invalid (you are solely responsible for this). To begin the prize claim process, a potential winner must respond as instructed to the announcement with their full name, country of residence, full mailing address (no p.o. boxes accepted) and date of birth within five (5) days of the announcement date. If the potential winner does not send the required information and within the specified time period, they may be disqualified, and an alternate potential winner may be selected in a separate random drawing. The name(s) of the winner(s) will be made available on written request for 1 (one) month after the Closing Date. The decision of the Promoter is final. We have the right to substitute any prize for an alternative prize of equal or greater value. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Promoter. Winners acknowledge that the Promoter and all other businesses affiliated with this competition and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the Prize being offered, except that each merchandise Prize shall be subject to its manufacturer’s standard warranty (if any). If a Prize notification or Prize is returned as undeliverable, or if you are found to be ineligible or not in compliance with these rules you will be disqualified, and the prize may be awarded to an alternate winner in a separate random drawing. You are responsible for all federal, state, local and income taxes associated with winning prize.

For US Winners: you may be required to furnish your Social Security Number for the sole purpose of preparation of tax forms as required by law.

For Canadian Winners: if you are a Canadian resident or your mailing address is in Canada, you will be required to answer, without mechanical, electronic or other aid, a time-limited, mathematical skill-testing question that will be administered by the promoter in a manner of its reasonable choosing. If you fail to answer the question correctly, you will be disqualified as if the Prize were undeliverable under this section 7.

8 Excluded Participants and Entries.

Employees of the Promoter, its holding or subsidiary companies, its agents or suppliers or anyone else professionally connected with the competition, including advertising and promotion agencies, or members of their families or households, are excluded from entering this competition. We will not admit entries which are automatically created by a computer or bot or script or other automated technology, created in bulk, have been altered or forged or tampered with, are illegible or incomplete or which generally in our reasonable opinion are inappropriate to admit.

9 Competition Judging.

The Winners will be chosen at random.

10 Ownership of Competition Entries and Intellectual Property Rights.

The Promoter does not claim any rights of ownership in your competition entry. Promoter is granted a non-exclusive, worldwide, perpetual, irrevocable and royalty-free licence to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for Promoter’s marketing or other commercial purposes. In addition, you agree to waive all moral rights in and to your competition entry, any accompanying material and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled.

11 Data Protection and Publicity.

If you are a Winner of the competition, you agree that we may use your name, image and place of residence and/or other provided personal information to announce the Winners of this competition and for any other reasonable and related promotional purposes without any payment to you. You promise that all of the information which you provide to us in connection with this competition shall be and shall remain complete and accurate. You promise that your entry will not contain anything: (a) that is or could reasonably be viewed as harmful, harassing, defamatory, libellous, obscene or invasive of another’s privacy; or (b) which you do not have a right to make available lawfully (including any material which infringes the rights of any other). By entering this competition, you agree that any personal information provided by you with the competition entry may be held and used by the Promoter, its affiliates, its agents and suppliers as detailed in our privacy policy at https://gangbeasts.game/privacy.

12 Limitation of Liability.

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winners or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected. The Promoter will NOT accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit for any reason or in any way.

13 Social Media.

You acknowledge that the competition is in no way sponsored, endorsed, administered by, or associated with Twitter, Instagram, or Discord. You agree to release Twitter, Instagram, and Discord from any responsibility to you in relation to the competition.

14 Dispute Resolution.

For EU and UK entrants: This competition shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England. This does not exclude any mandatorily applicable rules or remedies which would be available to entrant in a legal claim brought under the law of your EU Member State of residence.

For US entrants: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Washington. All issues and questions concerning the construction, validity, interpretation and enforceability of this competition, your rights and obligations, or the rights and obligations of the Promoter in connection with the competition, shall be governed by, and construed in accordance with, the laws of the state of Washington without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Washington. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief. THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.

For Canadian entrants: This competition shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law rules that would cause the application of any other jurisdictions’ laws, and the parties submit to the exclusive jurisdiction of the courts of the province of Ontario for the resolution of all disputes. Your remedy for any claim shall be limited to actual damages, and in no event shall you be entitled to recover punitive, exemplary, consequential, or incidental damages, including legal fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.

15 General.

(a) If there is any reason to believe that there has been a breach of these terms and conditions, we reserve the right at our sole discretion to exclude you from participating in the competition; and (b) We reserve the right to hold void, suspend, cancel, or amend the competition where it becomes necessary to do so.
